1. Contractor and services
Contractor: Росаус Владимир Владимирович (Vladimir Rossaus). Contact: hello@rossaus.com. Jurisdiction-specific details appear in Legal details & documents and are confirmed in the individual proposal.
Services may cover a defined marketing task, work alongside a marketing team or a consultation. Actions, deliverables, territory, timing, price, currency and payment terms are set in a written proposal or contract.
2. Proposal and acceptance
General descriptions and an enquiry do not create a payment obligation. These terms without an agreed scope and price are not an unconditional offer for any work.
An individual proposal is an offer where it includes the essential terms and expressly provides for acceptance. It remains valid for its stated period. Acceptance takes the form specified in that proposal, such as written confirmation or agreed payment. These terms form part of the proposal only by express reference.
Where a separate contract is signed, its agreed provisions and mandatory law apply. Communication through agreed email addresses may evidence agreements to the extent permitted by law.
3. Scope and changes
Before starting, the parties agree on the task, actions, deliverables, acceptance criteria and responsibilities. Advertising budgets, third-party services, development, design and other contributors are included only by express agreement.
New tasks or changed assumptions require written agreement on any revised fee and timing. Additional budget is not spent without approval.
4. Payment and documentation
Payment uses the bank details and currency in the proposal. Advance payments, stages, fees and due dates are agreed before work starts. This website does not accept payments.
Services within an active Russian NPD regime receive an official “My Tax” receipt. Documentation and tax duties for Kazakhstan and other partners depend on the transaction. Payment terms do not guarantee availability of a particular payment platform.
5. Responsibilities
The contractor delivers the agreed work, manages the budget within their role and communicates material circumstances affecting delivery.
The client provides agreed access and accurate data, a contact person and timely approvals, and ensures the legality of the product, advertising claims and supplied data. Delayed information or approvals may affect timing; any revised schedule is agreed.
6. Delivery and acceptance
Deliverables are provided through the agreed channel. The client reviews them against the agreed criteria and sends specific comments within the period set by the proposal.
Deviations from scope are corrected within a reasonable agreed period. A changed brief is not a defect correction. These general terms do not make silence acceptance without a separate lawful agreement.
7. Results and liability
The contractor is responsible for agreed actions and material quality within their role. Sales or growth targets are objectives unless expressly made contractual commitments.
Sales also depend on the product, pricing, market, availability and lead handling. The contractor identifies obstacles and data limitations. Liability follows the contract and applicable law; mandatory consumer rights are not excluded.
8. Confidentiality and rights
Non-public project information is not disclosed without permission except where required by law. Publishing a client name, material or result as a case study requires separate agreement.
Usage rights, duration and territory for created material are set in the proposal. Third-party platforms, fonts and other licensed items remain subject to their owners’ rights. Required licences and access are agreed separately.
9. Cancellation and refunds
To cancel or reschedule, contact hello@rossaus.com. The parties determine completed work, necessary documented costs and any remaining payment.
Unused advance payment is returned after accounting for completed work and mandatory law. These terms do not impose unconditional non-refundable payments. Withdrawal rights and mandatory refund deadlines are governed by applicable law.
10. Disputes and governing law
The parties first discuss a written claim describing the circumstances and requested remedy. Response periods and mandatory claim procedures follow applicable law and the agreement.
Governing law and forum are agreed for the specific contract, accounting for the parties’ countries. Mandatory consumer and data rules continue to apply. Statutory conflict-of-law rules apply where there is no agreement.
